Our agreement
These terms are an agreement between you and Sparkmentis (“we”, “us”), which operates SparkMentor. By creating an account or using SparkMentor, you accept them and our Privacy Policy. If you don’t agree, please don’t use SparkMentor.
Who can use SparkMentor
You must be at least 13 years old. If you’re under 18 (or under the age of majority where you live), you need a parent’s or guardian’s permission. They accept these terms for you and are responsible for your use of SparkMentor.
Give accurate information when you sign up, and keep it up to date.
Your account
- Keep your password safe and don’t share your account, which is for one person. You’re responsible for what happens in it, so tell us at once if you think someone else has used it.
- You can be signed in on a limited number of devices at the same time: two on Free and Standard, four on Pro.
- We send service messages about your account, security and billing. They’re part of using SparkMentor.
Using SparkMentor fairly
Don’t use SparkMentor to:
- cheat, for example to get answers during a test or exam, or to hand in AI-written work as your own where that isn’t allowed;
- break the law or anyone’s rights, or upload content you don’t have permission to share;
- harass, threaten or harm anyone, or create sexual, violent, hateful or otherwise harmful content;
- probe or break our security, upload malware, scrape or overload the service, or get around limits, credits or payments;
- misuse welcome credits, referrals, promo codes or offers, for example by making extra accounts;
- copy, resell or build a competing product from SparkMentor or its answers.
Public profile handles must not be offensive or misleading. We may remove content or handles that break these terms.
AI answers and academic honesty
SparkMentor uses AI, and AI makes mistakes. Answers, hints, quiz questions and grading, summaries, cards and study plans can be wrong, incomplete or out of date. Check anything important with your teacher, your textbook or another reliable source, and use “Report this answer” when something looks off.
SparkMentor is a study aid, not a replacement for your teachers, and it doesn’t give professional advice, whether medical, legal, financial or otherwise.
The tutor is designed to help you understand, with hints before full answers. Follow your school’s rules about AI. You’re responsible for the work you hand in.
Plans, credits and payments
Many features are free. Others use credits, and every paid action shows its cost before you use it.
- Credits. New accounts get welcome credits once. Every plan, the free one included, adds an allowance of plan credits every month. Plan credits are used first and reset each month, so unused ones don’t carry over. Credits you buy as top-ups, or earn through referrals and promotions, don’t expire while your account is open.
- What credits are. Credits let you use paid features. They have no cash value and can’t be sold, transferred or exchanged for money.
- Charging. Some actions are paid in advance, and your credits come back if they fail. Others are charged only when they succeed, and an answer you stop early is charged only for what was written. If an answer costs more than your remaining balance, we charge what’s left. Voice calls use credits as they go, within your plan’s monthly voice minutes.
- Payments. Stripe processes payments, in US dollars or, for accounts in India, Indian rupees. Prices are shown before you pay, and taxes may apply depending on where you live.
- Renewal. Plans renew automatically every month or year until you cancel. An upgrade starts at once: you pay a prorated amount for the rest of the period and get the extra credits straight away. A downgrade, or a switch from yearly to monthly, starts at your next renewal. If a renewal payment fails and isn’t fixed, your plan ends and its plan credits are removed. Credits you bought stay.
- Auto top-up is optional. While it’s on, we charge your saved card for the pack you picked each time your balance drops below the level you chose, at most once a day and four times a month.
- Android app. Plans and credits can’t be bought in the Android app. A plan or credits you already have work there too.
We may change prices or what plans include. A price change applies from your next renewal, and we’ll tell you before then.
Cancelling and refunds
You can cancel your plan any time in Plan & credits. You keep the plan and its credits until the end of the period you’ve paid for, you won’t be charged again, and you can resume it before then.
Unless the law requires otherwise, payments aren’t refundable, and we don’t refund partly used periods or unused credits. If you think you were charged by mistake, email sparkmentis@gmail.com within 30 days and we’ll look into it. Any money-back guarantee we advertise applies under the conditions stated with it.
Deleting your account cancels any subscription at once and ends your credits. It doesn’t refund the current period.
Your content
What you create or upload, such as questions, notes, files and cards, stays yours. You give us a worldwide, non-exclusive, royalty-free licence to store, copy, process and display it only as needed to run, secure and improve SparkMentor for you, for example to send your question to our AI providers for an answer, or to show your public profile to people you share it with. The licence ends when you delete the content or your account, apart from backups and logs, which roll off within 30 days.
You’re responsible for your content and must have the right to share it. You may use the answers SparkMentor gives you for your own learning.
SparkMentor itself, including the app, its design, the brand and our own materials, belongs to us and our licensors. We give you a personal, non-transferable right to use it under these terms.
Connected services and other sites
If you connect Google Classroom or Sparkmentis, their own terms apply too, and we access only what you allow. Links to other sites, like YouTube videos, are there for convenience. We’re not responsible for those sites.
Ending your account
You can delete your account at any time (here’s how).
We may suspend or close an account that seriously or repeatedly breaks these terms, puts others at risk, or where the law requires it. When it’s reasonable, we’ll tell you first and give you a chance to download your data.
We may change, add or remove features, and we may stop offering SparkMentor. If we stop SparkMentor, we’ll give you reasonable notice.
Disclaimers
SparkMentor is provided “as is” and “as available”. As far as the law allows, we don’t promise that it will always be available or free of errors, that AI answers will be accurate or complete, or that using it will lead to particular results, such as grades or exam scores.
Nothing in these terms takes away rights you have under consumer laws that can’t be excluded.
Limitation of liability
As far as the law allows, we’re not liable for indirect, incidental, special or consequential losses, or for lost data, profits or opportunities, including results in tests or exams, arising from SparkMentor.
As far as the law allows, our total liability for any claim about SparkMentor is limited to the greater of what you paid us in the 12 months before the claim and 50 US dollars (or the equivalent in your currency).
These limits don’t apply where the law doesn’t allow them, for example to liability for fraud, or for death or personal injury caused by negligence.
Changes to these terms
We may update these terms. The date at the top shows the latest version. If a change matters, we’ll tell you in the app or by email before it takes effect. If you keep using SparkMentor after that, the new terms apply. If you don’t agree, you can delete your account.
General
These terms and our Privacy Policy are the whole agreement between you and us about SparkMentor. If part of them can’t be enforced, the rest still applies. If we don’t enforce something straight away, we can still do so later. You can’t transfer your rights under these terms. We may transfer ours to a company that takes over SparkMentor.
